A panel of federal judges has decided not to appoint John Sarcone permanently as the United States Attorney for the Northern District of New York, just days after Sarcone expressed confidence that his extension was approved.
Sarcone, who was initially appointed by Attorney General Pamela Bondi in March of this year on an interim basis, faces the expiration of his term on Tuesday, as reported by WXXI.
In an official statement released on Monday, the Board of Judges for the Northern District of New York announced, “The Board of Judges of the United States District Court for the Northern District of New York declines to exercise the authority granted pursuant to 28 U.S. Code § 546(d) to appoint a United States attorney for the Northern District of New York.”
The decision unfolded in the wake of Sarcone’s recent alarming encounter in Albany. Last month, he informed Fox News that he felt his life was in danger after a confrontation with an illegal immigrant armed with a knife. According to the Department of Homeland Security, Saul Morales-Garcia, a Salvadoran national, allegedly lunged at Sarcone while wielding a knife and shouting aggressively in another language.
After initially stating that he received information from federal judges indicating that his appointment was to be extended, Sarcone’s hopes were dashed when the panel subsequently clarified that no such action had taken place.
As it stands, Sarcone’s prospects for assuming the position permanently hinge on a formal nomination from President Donald Trump followed by Senate confirmation, WXXI reported.
The Northern District of New York encompasses a vast area stretching from central New York to the Canadian border, including key cities such as Albany, Syracuse, and Binghamton.
Sarcone expressed gratitude during his interim appointment, saying, “Thank you, Attorney General Bondi, for trusting me to carry out this important mission, and most importantly, thank you President Trump for once again having faith and confidence in me to do my part to accomplish one of your most important tasks – to restore public confidence and trust in our government and the Department of Justice.”
His professional background includes extensive service in public and private legal roles. The Department of Justice highlighted that Sarcone previously served as the Northeast and Caribbean Regional Administrator for the U.S. General Services Administration from 2018 to 2021. In that capacity, he managed a large team responsible for federal buildings, procurement, and IT initiatives, collaborating with numerous federal agencies and courthouses within the Northern District of New York.
Earlier in his career, he held positions as Town Attorney for Eastchester, New York, and as General Counsel for the United Federation of Special Police Officers, Inc., as well as the Association of Commuter Rail Employees.
Sarcone also founded a general practice law firm specializing in providing legal advice to small businesses and family-owned corporations. His practice included managing substantial real estate transactions and litigating various issues such as business disputes, insurance defense, and toxic torts.
In contrast to Sarcone’s situation, U.S. Attorney Michael DiGiacomo in the Western District of New York was permanently appointed last month before his interim term expired, according to WXXI.
