圣迭戈青少年绑架、折磨并杀害案,提华纳男子被判有罪

一名提华纳男子因在绑架、折磨并杀害一名圣迭戈少年一案中被陪审团判定有罪,距离该案件发生近五年。

联邦检察官声称,尽管至少有五人参与了19岁受害者的绑架,但正是Brian Alexis Patron Lopez开枪射杀了Miguel Anthony Rendon,时间是2020年5月。

检察官表示,Patron用手枪对Rendon的头部射击了五次,并将他的尸体留在了一个峡谷中。

经过为期六天的审判和约五小时的合议,圣迭戈联邦陪审团判决Patron在参与毒品贩运的同时故意杀人罪、导致死亡的绑架罪以及导致死亡的绑架阴谋罪名成立。

“谋杀的过程被录像记录了下来,”助理美国检察官Mario Peia和Sasha Foster本月在审判简报中写道。

“(Patron)后来还向他人展示了这一视频,并为此自夸。”

检察官认为,虽然其他人也参与其中,但Patron控制了Rendon的绑架,并致命射击他以提升在毒品贩运组织中的地位。

Patron的律师在周三对判决未做评论。

另外四名被告此前已承认参与绑架和杀人,均在等待宣判。

Alan Lomeli-Luna承认在毒品贩运活动中故意杀人的罪名,在他的认罪协议中承认“(他)和他的共谋者故意通过多次射击受害者的头部来杀死他。”

Lomeli-Luna维持他没有开枪,但在认罪中承认检察官“能够证明(他)指使、命令、诱导、采购或导致受害者死亡。”

检察官表示,Lomeli-Luna在杀人时充当了望风者。

Wyatt Valencia-Pacheco、Jonathan Emmanuel Montellano-Mora和Luis Armando Dorantes Rivera Jr.分别承认了绑架罪。

Dorantes还承认了绑架阴谋罪。

根据检察官的说法,受害者Rendon在5月27日试图通过边境过境通道把不到半磅的冰毒走私到美国时被逮捕。

他很快被释放,并收到一张未来出庭的通知。

次日,Rendon与Lomeli-Luna达成协议,准备走私超过2磅的冰毒越过边境。

但在取走毒品后不久,他据称偷走了这些毒品。

检察官称,Rendon随后使用了经过伪造的5月27日通知,试图让人觉得他实际上在5月28日被捕,并且美国当局已经扣押了更大数量的毒品。

被告们对此骗局始终不信,在几小时内,他们向Rendon发送了威胁信息。

尽管受到威胁,Rendon第二天依然计划将偷来的毒品出售给一名在提华纳的朋友。

当天深夜,Patron和其他被告得知Rendon在提华纳市中心南部的El Parador旅馆住宿。

旅馆的监控录像显示,Patron和其他人将Rendon从他的房间下方的车库拖出来,殴打他,然后强行将他放进一辆宝马车。

之后,这些被告将Rendon转移到一个空旷的田野,在那里继续对他施暴,随后又转移到一处空屋和Luxor旅馆。

在这座房子和第二个旅馆期间,被告与Rendon的母亲和继父联系,要求以金钱或毒品作为释放他的交换,检察官表示。

当时,Rendon的家庭正在筹集赎金,但绑架者很快就中断了联系。

检察官声称,在5月30日下午,一名未起诉的共谋者向Patron提供了一把左轮手枪,并告诉他“要做他必须做的事”。

当晚,Patron和另一名未起诉的共谋者将Rendon带入附近的峡谷,Patron将Rendon的头部射击了五次,而Lomeli-Luna则在峡谷顶部充当望风者。

在针对Patron的电子设备和社交媒体账户的搜查令中,一名FBI特工写道,多名证人证实见过谋杀的视频,尽管检察官表示截至本月初仍未能获取该视频。

检察官还指出,一名未参与Rendon绑架的青少年获悉了一些细节,假装自己是绑架者,以此向Rendon的继父勒索1000美元。但在那时,Rendon已被杀害,检察官表示,这名青少年在州少年法庭被起诉并定罪。

今年早些时候,Patron的辩护律师Meghan Blanco请求美国地区法官William Hayes将圣迭戈美国检察官办公室和FBI圣迭戈现场办公室从Patron的案件中移除,理由是当地FBI特工与一名圣迭戈警察的兄弟有利益冲突,该兄弟是案件中一名合作证人。

法官Hayes拒绝了Blanco的动议,基于FBI特工在案件中所扮演的有限角色。

Patron的宣判定于7月进行,他面临两项罪名至少终身监禁的可能。
