In a troubling situation affecting residents of Las Vegas, a local woman, Pauline Williams, has found herself facing a lien on her home due to unpaid trash bills by Republic Services.
Williams, who identifies as a disabled single mother of four, expressed her disbelief upon receiving a summons indicating that multiple liens had been placed against her home, totaling over $7,000 owed to the waste management company.
Her household, Williams contends, does not produce conventional trash. She has relied on composting and feeding scraps to her backyard chickens, even going so far as to deliver recyclables to a local plant on Sunset Road.
However, after receiving a notice in April that threatened foreclosure on her home, she struggled to comprehend how it had come to this. “I have backyard chickens. I feed my scraps to them,” Williams stated in an email correspondence.
Republic Services, the exclusive waste collector in Clark County, insists that customers must have regular trash service even if they do not generate typical waste. Williams claims she requested to be billed solely for recycling services but was not accommodated in this manner.
This is not an isolated incident. Other Republic Services customers have reached out to Channel 13 over the years with similar complaints regarding liens and lawsuits due to unpaid trash bills.
Alex Mack, another resident, shared his experience of being informed of liens against his home upon trying to establish trash service. He revealed that an initial unpaid bill spiraled into a $2,600 debt, largely due to accumulating late fees and liens.
Living part-time in San Francisco before moving to Las Vegas full-time in 2016, Mack stated that he never disposed of trash in the city until he relocated. He raised concerns about the profit model created by the lien process, suggesting it serves as a significant revenue source for Republic Services.
Local regulations mandate that all residents must have trash service—Republic Services is the only provider authorized for solid waste collection in the area. This monopoly has led to legal complications; in 2016, the company faced a class action lawsuit regarding its collection practices, which was eventually settled.
Currently, lawyers at the Legal Aid Center of Southern Nevada have noted a disturbing rise in cases involving new liens on homes over unpaid bills.
Attorney Taylor Altman noted the difficult position many clients find themselves in, saying, “They can either try to pay the debt that’s being asked of them by Republic Services, that’s being alleged in the complaint, or they can fight it in court and for most of our clients, they can’t afford to do either.”
Altman emphasized the emotional toll this situation takes on vulnerable individuals, including low-income families, seniors, and those with disabilities. The financial implications can escalate quickly, as Republic Services includes attorney fees in its lawsuits, which can be exorbitant and predatory.
“These attorneys’ fees—often the clients won’t know what they’re for, what work has been done. There’s no chance to negotiate the fees, and they are also not decided by any court,” Altman explained.
Fortunately for Williams, she has secured assistance from the Legal Aid Center. Residents facing similar challenges are encouraged to reach out for help, especially if they meet income qualifications.
