Transgender Asylum Seeker’s Detention Sparks Outcry Over Due Process Violations

PORTLAND, Ore. — A transgender asylum seeker from Mexico, identified only as O-J-M, is currently being held in a Tacoma detention center following her transfer from Portland by Immigration and Customs Enforcement (ICE).

Attorneys for O-J-M have filed multiple court documents seeking her return to Oregon and requesting her release on bail, arguing that federal authorities have failed to act in good faith throughout the immigration process.

According to her legal representation, the ordeal surrounding O-J-M’s detention demonstrates a confusing and opaque process reminiscent of Kafkaesque bureaucracy, especially for individuals who are compliant with immigration laws.

The attorneys from the Innovation Law Lab asserted that the governmental agencies manipulated the immigration system in violation of O-J-M’s right to due process, claiming that the rapid expulsion was unlawful.

A recent transcript from O-J-M’s asylum hearing on Monday revealed that the U.S. Department of Homeland Security sought to dismiss her asylum case. During the hearing, O-J-M expressed confusion about the meanings of the proceedings.

The immigration judge explained that accepting the dismissal would mean the government would not seek her deportation back to Mexico.
